My apologies if you've already read about the Orphan Works Act, but I felt this was necessary enough to post in case there are people who haven't heard about this bill.
Currently, as you probably know, in the United States your work is protected by copyright. According to the US Copyright Office on their 'copyright basics' page, "copyright protection subsists from the time the work is created in fixed form." What this means is, as soon as you create your picture, song, poem, or other original work, it is protected by United States copyright. If you want additional protection, you can register your work (individually or in a compilation) with the US Copyright Office for a fee. However, this is not required, and your work is still protected by automatic copyright even if you do not register it.
If someone uses your work without your permission, it is considered copyright infringement. This is why deviantART, for example, does not allow you to post screenshots from an anime or use music that is not your own in flash animations. That work is protected by copyright, and reposting it without the owner's permission is illegal.
But what if you find a picture that you really want to use, and you simply cannot find the owner to ask them permission to use it? This is where the issue of 'orphan works' comes into play. Many people and organizations, particularly museums, want to pass a law allowing unidentifiable works to be used without being barred by copyright law. If a painting belongs to an artist who cannot be found to claim it, these organizations still cannot legally use the work unless it is proven the work is public domain. The Orphan Works page on the US Copyright Office website explains the issues concerning possibly orphaned works:
"During 2005, the Copyright Office studied issues raised by “orphan works”— copyrighted works whose owners may be impossible to identify and locate. Concerns had been raised that the uncertainty surrounding ownership of such works might needlessly discourage subsequent creators and users from incorporating such works in new creative efforts, or from making such works available to the public."
In 2006, an orphan works bill was presented and rejected due to potentially abusive flaws. In April of 2008, the bill was presented again, with changes (see here: [link] ). This time, the bill included the usage of registries, that would, in theory, make it easier for artists to be found through identification of their art.
The problem that many concerned artists have brought up is that if the artwork is not registered, it cannot be found. Artwork that cannot be found using " a reasonably diligent search" (according to the American Society of Media Photographers) will be declared as orphaned. Since the current copyright protection of 'automatic' copyright would be discarded once the Orphan Works act is made a law, this means that if your work is not registered with a registry, it could erroneously be labeled as orphaned.
What does this mean for you? It means that any and all work that you have created could be considered 'orphaned' if you do not register with a registry. And not only one registry, since there is no limit to the number of registries, you may have to register with multiple registries. The Illustrators' Partnership points out many possible problems and opportunities for abuse if this becomes a law: [link]
The reason this has many artists worried is because of these possibilities for abuse. Let's say you only register in 9 out of 10 available registries. If a company that wants to use your work only looks in that 10th registry, it could be considered that the corporation performed "a reasonably diligent search", and your work is still considered orphaned. What about international artists whose work is found by a United States company? Obviously a Canadian artist or a German artist is not going to register their work to comply with a United States law. Would artists across the globe be at risk for their works being 'orphaned,' and therefore up for free use in the United States, even if their work is protected by their country's copyright laws? Also, how much would it cost per image to register your work? Think about all the work you have made throughout your entire life. Even if it costs only $1 per image, that is still a very large amount of money. Now multiply that by the possible number of registries that will open up.
I am not trying to cause panic, but if this bill is passed, it can cause major problems for artists, musicians, writers, anyone who creates original work. I was first alerted to this by friends, and then by my professor who has been a professional illustrator for over 20 years. Many artists at my school are extremely concerned about this bill, as it could change their livelihoods. Current copyright laws protect our rights to our artwork. How would you like to be told by a federal court that since you didn't pay to register your work with a number of registries, that your painting no longer belongs to you?
So what can we do? We can tell our friends, our family, anyone who could be affected by the Orphan Works act. Also, write letters to Congress.
